General Terms and Conditions of Sale (T&Cs) – The Barn Bio Market

1. Seller identity

The site https://the-barn-biomarket.myshopify.com/ (hereinafter the "Site") is operated by ROOTZ MARKET, trading under the commercial name The Barn Bio Market, headquartered at 1060 Saint-Gilles, Chaussée de Charleroi 92, registered with the Crossroads Bank for Enterprises under number 0668.997.617 (hereinafter "The Barn Bio Market").

These General Terms and Conditions of Sale (hereinafter the "Terms and Conditions") govern the sales of products offered on the Site with home delivery only.

2. Scope of application

The Terms and Conditions of Sale apply to any order placed on the Site by any customer acting as a consumer, that is, a natural person acting for purposes outside their commercial, industrial, artisanal, or professional activity (hereinafter the "Customer"). The Customer declares having read and accepted the Terms and Conditions of Sale before placing an order.

The Site is intended for normal end use and not for resale. The Barn Bio Market reserves the right to refuse or limit any order whose quantities, frequency, or nature reasonably suggest resale activity or non-domestic use.

By confirming their order, the Customer acknowledges having read and unconditionally accepted the Terms and Conditions of Sale.

3. Products and product information

The products offered for sale are those described on the Site, subject to available stock and delivery areas served.

The Barn Bio Market takes great care to describe the products. However, photographs, visuals, and product presentations are for illustrative purposes only. Minor variations in presentation, size, color, variety, packaging, or origin may exist, especially for fresh, seasonal, artisanal, or small producer products, without affecting the essential characteristics of the product.

The essential features of the products are listed on the Site before ordering. For food products, The Barn Bio Market provides, before order confirmation, the legally required information available for distance selling. For unpackaged or bulk products, the mandatory information applicable, especially regarding allergens, is communicated on the Site or by any other means clearly indicated to the Customer before ordering.

The Customer is invited to carefully read the product information available on the Site as well as the information on the labeling or documents provided upon delivery, especially regarding allergens, storage conditions, expiration dates, and usage advice.

4. Availability, products by weight, and substitution

4.1. Availability 

Products are offered within the limits of available stock. Despite careful Site management, some products may become unavailable after order validation.

In case of unavailability, The Barn Bio Market may:

  1. cancel the concerned product and refund the corresponding amount; 

  2. offer a replacement product in accordance with article 4.3 below.

4.2. Products sold by weight or variable quantity

For certain fresh, bulk, or variable weight products, the price displayed on the Site is calculated based on an estimated weight or quantity. The final billed price corresponds to the weight or quantity actually prepared and delivered.

The total order amount may therefore vary slightly upwards or downwards. The Customer is informed of this on the receipt, order summary, or any other document given or sent after order preparation.

4.3. Replacement products

In case of product unavailability, The Barn Bio Market may, at its own discretion, offer a replacement product to the Customer. No replacement product will be provided without the Customer's prior agreement, given before order delivery.

When the Customer has accepted substitutions, The Barn Bio Market may replace an unavailable product with a comparable product in terms of nature, quality, use, and price range, within reasonable limits. 

5. Prices

All prices displayed on the Site are expressed in euros and include all taxes.

Unless otherwise indicated, delivery fees, any service charges, deposit packaging, or other clearly applicable additional fees are indicated separately before the final order validation.

The applicable price for products is the one displayed on the Site at the time of order validation, subject to:

  • products sold by weight or variable quantity referred to in article 4.2;

  • obvious material errors;

  • adjustments resulting from a modification requested by the Customer before order preparation.

The Barn Bio Market cannot be held to sell at a clearly erroneous price due to an obvious technical, material, or human error.

6. Ordering process and contract conclusions

The Customer selects the desired products, completes their cart, and follows the steps indicated on the Site.

Before validating the order, the Customer can check its details, correct any errors, and modify the provided information.

Final validation of the order constitutes an obligation to pay.

After recording the order, The Barn Bio Market sends the Customer an electronic acknowledgment of receipt including at least a summary of the order. This acknowledgment does not necessarily mean final acceptance of each product if some items are unavailable or still need to be adjusted based on actual weight.

The sales contract is deemed concluded at the time of sending the order confirmation by The Barn Bio Market, subject to the adaptations provided by the Terms and Conditions regarding unavailability, variable weight products, expressly authorized substitutions, and legitimate refusals mentioned below.

The Barn Bio Market reserves the right to refuse an order for legitimate reasons, notably in cases of:

  • manifestly inaccurate or incomplete information;

  • non-payment or previous payment incident;

  • reasonable suspicion of fraud, abuse, or resale;

  • exceptional unavailability;

  • impossibility of delivery to the indicated address;

  • force majeure.

In case of refusal of an already paid order, the amounts collected will be refunded as soon as possible.

7. Payment

Payment is made at the time of the order, via the payment methods offered on the Site.

The Barn Bio Market may use a pre-authorization, provisional charge, or any equivalent mechanism when necessary to account for:

  • products with variable weight;

  • accepted replacement products;

  • technical adjustments related to the actual preparation of the order.

The Customer guarantees they are authorized to use the chosen payment method.

In case of authorization refusal, payment rejection, or cancellation, the order may be suspended or canceled.

8. Delivery

8.1. Delivery area and time slots

Deliveries are made only in areas served by The Barn Bio Market, listed on the Site at the address https://the-barn-biomarket.myshopify.com/en/pages/information-livraisonThe available delivery slots and days are indicated during the ordering process.

8.2. Deadline  

The Barn Bio Market makes every effort to deliver within the announced time slot or deadline. Unless expressly agreed on another date, delivery takes place no later than the applicable legal deadline.

In case of delay, The Barn Bio Market informs the Customer as soon as possible and offers, depending on the circumstances, a new delivery, maintaining the order, or its partial or total cancellation.

8.3. Address and access

Delivery is made to the address provided by the Customer when ordering. The Customer is responsible for the accuracy of the information provided and must ensure that delivery can be made under normal access and safety conditions. Delivery takes place outside, in front of the Customer’s front door. Any special access constraints must be reported before order confirmation and may be a legitimate reason for The Barn Bio Market to refuse delivery.

8.4. Receipt 

Delivery is considered completed when the products are handed over to the Customer or to any person present at the delivery address who can reasonably be considered authorized to receive the order.

The Customer is invited to check the order upon receipt and immediately report any apparent anomalies to the delivery person or, failing that, to customer service as soon as possible.

9. Customer absence during delivery

In case of the Customer’s absence at the agreed time, The Barn Bio Market will try, as far as possible, to contact them using the provided contact details.

If the Customer is unreachable or cannot receive the order within a reasonable time of 10 minutes, the delivery person from The Barn Bio Market takes back the order. All costs related to the service provided, including the balance of the ordered items, may be charged to the Customer.

If a second delivery is requested by the Customer and accepted by The Barn Bio Market, additional delivery fees may be charged.

10. Transfer of risks

The risk of loss or damage to the products is transferred to the Customer when they, or a third party designated by them who is not the carrier, physically take possession of the products.

If the Customer has expressly requested contactless delivery or drop-off at a specified location, the risk is transferred at the time of drop-off according to their instructions.

11. Right of withdrawal 

11.1. Principle

For products not subject to a legal exception, the consumer Customer has a period of fourteen (14) calendar days from the day after receiving the products to exercise their right of withdrawal, without having to justify their decision.

The Customer may exercise this right by informing The Barn Bio Market of their decision through an unambiguous statement sent by a means of communication that allows it.

11.2. Exceptions

In accordance with applicable law (Art. VI.53 CDE), the right of withdrawal does not apply notably not including:

  • the supply of goods that are likely to deteriorate or expire rapidly;

  • the supply of sealed goods that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer after delivery;

  • the supply of goods which, after being delivered, are by their nature mixed inseparably with other items.

Consequently, no right of withdrawal can be exercised for products ordered on the Site insofar as they fall under one of the legal exceptions.

11.3. Return conditions

In case of valid withdrawal, the Customer returns the products concerned within fourteen (14) days following the communication of their decision.

Direct return costs are borne by the Customer, unless The Barn Bio Market expressly agrees to organize a pickup or if the law requires another solution.

The Customer is responsible for the depreciation of goods resulting from handling other than what is necessary to establish the nature, characteristics, and, if applicable, the proper functioning of these goods.

11.4. Refund

In case of valid withdrawal, after receipt and inspection of the item, The Barn Bio Market refunds the Customer all payments received for the products concerned, including, if applicable, the corresponding standard delivery fees, within fourteen (14) days from the date it is informed of the withdrawal decision.

The refund is made via the same payment method used during the order, unless the Customer expressly agrees to another method.

12. Compliance, defective products, and claims

The Customer benefits from the legal guarantees applicable under Belgian law.

Without prejudice to its legal rights, the Customer is invited:

  • to immediately report any apparent defect, product error, visible damage, shortage, or freshness problem upon delivery;

  • to contact customer service within 24 hours for any anomaly related to fresh, perishable, refrigerated, or frozen products;

  • to keep the products concerned, their packaging, and, if possible, any photo useful for processing the claim.

For non-perishable products, any claim regarding compliance must be made within a reasonable time from the discovery of the problem.

The Barn Bio Market may, as the case may be, offer a replacement, a full or partial refund, or any other appropriate solution in accordance with applicable law.

13. Alcohol sales

Alcoholic beverages can only be sold or delivered to persons of the required legal age.

The Barn Bio Market reserves the right to request proof of identity at the time of delivery and to refuse the handover of alcoholic beverages in the absence of sufficient proof or in case of reasonable doubt about the age of the person receiving the order.

In this case, alcoholic products will be removed from the order and refunded according to the applicable terms, without affecting the rest of the delivery.

14. Use of digital channels

The Client is aware of the limits and risks related to the use of the internet or any other communication means allowing The Barn Bio Market to provide its services. The Barn Bio Market cannot be held responsible for any damage caused by the Client's use of its digital channels. The Client is personally responsible for verifying that these websites and apps are free from viruses and other elements that could cause damage.

15. Force Majeure

The Barn Bio Market cannot be held responsible for any delay, non-performance, or partial performance resulting from force majeure or an event reasonably beyond its control, including but not limited to: severe weather, accident, widespread breakdown, logistical interruption, strike, network unavailability, authority decisions, health incident, or exceptional supply disruption.

In such a case, The Barn Bio Market will inform the Client as soon as possible and may suspend, adapt, or cancel the order or delivery, without any liability other than the refund of amounts unduly received for products not supplied.

16. Personal Data

Personal data collected in connection with the order are processed in accordance with applicable data protection legislation and the Privacy Policy available on the Site.

17. Intellectual Property

The Site, its content, texts, photographs, logos, visuals, databases, and graphic elements are protected by intellectual property rights. Unless prior written authorization from The Barn Bio Market or the relevant rights holders is obtained, any reproduction, representation, extraction, adaptation, or use is prohibited, except for strictly private use.

18. Customer Service, Complaints, and Amicable Settlement

For any questions, difficulties, or complaints, the Client can contact customer service at the contact details provided in Article 1.

The Barn Bio Market will strive to handle complaints within a reasonable time.

19. Applicable Law and Jurisdiction

Without prejudice to the Client's special rights, the Terms and Conditions are governed by Belgian law and the courts and tribunals of Brussels will have jurisdiction over any dispute concerning them.

20. Final Provisions

If any clause of the Terms and Conditions is deemed null, illegal, unenforceable, or inapplicable, this will not affect the validity of the other clauses.

The Barn Bio Market may modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect at the time of the order.
